Legislative Report (Vol. XXV No. 11) March 24, 2006 Funnel Date Anti-Climactic This Year

Today marks another of the legislatively imposed funnel dates, a procedures intended to reduce the number of bills still eligible for debate. In the past a bill that did not meet the requirements of the most recent funnel date could usually be thought of as dead for the session. However under the political realities of a evenly split Senate nothing is as it was in the past. With the assumption that many educational issues, both financial and policy will be bargained during the waning days of the session, nothing will be truly dead this year until the session officially ends.

Thus you will see a great many bills in the status section below with the label DBF (Dead by Funnel). While procedurally accurate, it may not paint a true picture of the actual status as some of them will be in the mix at the end.

School Hours Passes House

The House approved a bill eliminating the requirement for schools to be in session 180 days and replaced it with a minimum number of hours of instructional time. House File 2709 requires grades 1-6 to have 990 hours of instruction and grades 7-12 are required to have 1,080 hours of instruction, at a minimum.

The bill directs the State Board of Education to establish rules that define instructional time, which cannot include recess, lunch period, time for non-instructional assemblies, late arrival or early dismissal times required for emergency health or safety factors, weather-related late starts or early releases, or time used for staff development.

Under current law, the minimum school day was defined as 5.5 hours of instruction a day, which excludes the lunch period, but may include passing time between classes. Schools are also allowed to continue to include time spent on parent-teacher conferences as instructional time.

The bill delays the implementation date until July 1, 2008, to allow time for schools to review their current calendars. Final determination on this bill is unclear at this time.

House Committee Supports School Start Date Language

SF 2272 commonly referred to as the DE clean up bill passed the House Education Committee this week. While this bill usually includes only non-controversial legislation the Senate amended on a change in the school start date prior to passage last week. The bill prohibits school from starting on any day prior to August 25, with no waivers for early starts. Innovative calendar provisions don't change.

The bill was taken up for debate in the House Committee on Thursday. An amendment to take the start date back to the current code language was defeated 13-8 and the bill was sent on to the full House for future debate.
